On 24 August 2023, the Disciplinary Tribunal found Mr Jacotine breached:
• Article 36(a) of the 11 May 2022 Constitution, when he “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d) of the 11 May 2022 Constitution as having “engaged in: … (ii) conduct which is derogatory to, or not in the best interest of, the Company or its Members” by failing to provide a copy of a client’s documentation.
• Article 39(a)(ii)(C) of the 14 May 2019 Constitution, when he “failed to observe a proper standard of professional care, skill or competence” by being the sole director of a company that was the subject of an adverse finding by the Tax Practitioner’s Board that terminated the company’s registration for four (4) years.
Mr Jacotine attended the Disciplinary Tribunal Hearing and admitted the complaints.
Penalty and costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
Complaint 1:
• A severe reprimand
• A Fine of $3,000
• He must successfully complete CPA Australia’s ‘My Firm My Future online course “Understanding Conflicts of Interest” by 31 December 2023.
Complaint 2:
• A severe reprimand
• A fine of $5,000
• He must successfully complete the CPA Australia Best Practice Program Review by 30 June 2024.
The member was ordered to pay a contribution to CPA Australia’s costs of $2,458.
