Member’s name: Andy Choi
Date of Hearing: 24 September 2026
Division: New South Wales
Tribunal: One Person Tribunal
On 24 September 2026 the One Person Tribunal found Mr Andy Choi breached CPA Australia’s 11 May 2022 Constitution (“the Constitution”) in that he had “committed, participated in or been involved with an Adverse Event” as defined in:
Complaint 1
Article 76(h) of the Constitution in that he “became the subject of a final adverse finding in relation to the Member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction;” with respect to the decision of the Australian Securities and Investments Commission dated 18 September 2025, effective 25 September 2025, disqualifying him from being an approved SMSF auditor under subsection 130F(2) of the Superannuation Industry (Supervision) Act 1993 (Cth).
Background
According to CPA Australia’s records, Mr Choi has been a member since 11 February 1992 and, at all material times, was a registered approved SMSF auditor with ASIC, SAN 100016439, registered on 13 March 2013.
The ASIC adverse finding followed an ATO referral concerning Mr Choi’s SMSF audit work and included findings relating to:
- independence failure;
- a failure to obtain sufficient appropriate audit evidence;
- a failure to lodge an Auditor Contravention Report;
- a failure to retain an SMSF audit file;
- signing an ATO declaration on 6 October 2023 confirming he had provided all information and documents relied upon in forming his audit opinion for an SMSF.
ASIC disqualified Mr Choi from being an approved SMSF auditor on 18 September 2025, effective 25 September 2025.
Complaint 2
Article 76(h) of the Constitution in that he “became the subject of a final adverse finding in relation to the Member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction;” with respect to the Deed of Consent entered into with Chartered Accountants Australia and New Zealand (CA ANZ) on 3 March 2026, pursuant to which the CA ANZ Professional Conduct Committee determined that Mr Choi had committed offences under By-Laws 40.9(a)(vii), 40.9(a)(viii) and 40.9(a)(xvi).
Background
On 3 March 2026 the CA ANZ Professional Conduct Committee determined that the complaint warranted referral to a CA ANZ Disciplinary Tribunal, but proposed a Deed of Consent instead.
Mr Choi accepted that proposal. The sanctions recorded were a censure, a requirement that he and his Practice Entity submit to a quality review, a requirement that he complete the Ethics – Conflict of Interest course, payment of $278 towards CA ANZ’s costs, and publication disclosing his name and location.
Decision
The One Person Tribunal found Complaints 1 and 2 sustained by written resolution based on the Member’s admission and consent to the determination and the penalty.
Penalty and Conditions
The One Person Tribunal’s Determination was made by Written Resolution, in accordance with By-Law 5.6(n)(i), and is based on the Member’s admission of the Complaint and consent to the penalty proposed by CPA Australia in accordance with By-Law 5.6(a).
The One Person Tribunal considered the submissions and mitigating factors put forward by the Member and CPA Australia and found the Complaint sustained and imposed the following penalty:
Complaints 1 and 2:
