On 20 March 2025, the One Person Tribunal found Mr Ma breached CPA Australia’s 11 May 2022 Constitution:
- Article 36(a), by having “committed, participated in or been involved with an Adverse Event” as defined in Article 76(c) in that he “breached this Constitution (or the constitution of the Company in force immediately before the Amending Date), By-Laws, Code of Professional Conduct or the Applicable Regulations” by breaching By-Law 9.5(b) of the 18 May 2023 By-Laws which provide:
“Every Member holding a current Public Practice Certificate must, for so long as the Member holds the Public Practice Certificate: …
(b) In relation to a Quality Review relating to that Member, comply with all Quality Review steps and requirements and successfully complete a periodic Quality Review within the Quality Review Prescribed Timeframes …”, in failing to successfully complete a Quality Review (also known as the Best Practice Program Assessment) within the Quality Review Prescribed Timeframes. - Article 36(a) by having “committed, participated in or been involved with an Adverse Event” as defined in Article 76(c) in that he “breached this Constitution (or the constitution of the Company in force immediately before the Amending Date), By-Laws, Code of Professional Conduct or the Applicable Regulations” by breaching By-Law 5.2(a)(iii) of the 1 January 2024 By-Laws which provide:
“As soon as practicable after a Complaint is allocated to them, a Professional Conduct Officer must: …
B. The Member will be in breach of By-Law 5.2(a) and this breach must be dealt with concurrently with the Complaint”, in having been notified by the Professional Conduct Officer of the Complaint by way of letter dated 4 September 2024, Mr Ma failed to provide a satisfactory explanation in writing within 10 Business Days, as requested, or at all.
(iii) require the Member to provide a satisfactory explanation in writing with respect to the matters referred to in Complaint. Mr Ma attended the One Person Tribunal and denied the complaints.
Penalty and Costs:
The One Person Tribunal found the Complaints sustained and imposed the following penalty:
- Forfeiture of Membership
- Member not eligible for readmission until he successfully completes a Practice Review as a non-member at his own cost.
- A severe reprimand
- A Fine of $1000.
Mr Ma was ordered to pay a contribution to CPA Australia’s costs of $7,946.
