On 5 August 2025, the Disciplinary Tribunal found Mr John Janssen breached Article 36(a) of CPA Australia’s 11 May 2022 Constitution (“the Constitution”), in having “committed, participated in or been involved with an Adverse Event” as defined in:
- Article 76(e) of the Constitution as having “failed to observe a proper standard of professional care, skill or competence” by failing to comply with the principle of professional competence and due care in that he did not act diligently and in accordance with the requirements of an assignment, carefully, thoroughly and on a timely basis, and/or did not act in accordance with applicable technical and professional standards, in his failure to respond contrary to R113.1(b) of APES 110.
- Article 76(c), as having “breached this Constitution (or a constitution of the Company in force from time to time before the Amending Date), By-Laws, Code of Professional Conduct or the Applicable Regulations)” by failing to comply with By-Law 5.2(a)(iii) of the 1 January 2024 By-Laws that required a satisfactory explanation in writing with respect to matters referred to in the Complaint.
Mr John Janssen did attend the Disciplinary Tribunal Hearing and admitted the Complaints.
Penalty and Costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
Complaint 1:
- A severe reprimand.
Complaint 2:
- Forfeiture of membership. Not eligible for readmission until the member provides a satisfactory written response to the complaint.
- A Fine of $2,000.
The Member was ordered to pay CPA Australia’s costs of $7,775.00.
