On 9 May 2025 the Disciplinary Tribunal found Mr Donald Douglas breached CPA Australia’s 11 May 2022 Constitution:
- Article 36(a) in that he had “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d) by having “Engaged in: (i) dishonourable practice in any profession or undertaking; or (ii) conduct which is derogatory to, or not in the best interests of, the Company or its Members”, by undertaking audit work without holding registration as a company auditor.
- Article 36(a) in that he had “committed, participated in or been involved with an Adverse Event” as defined in Article 76(c) by having “breached this Constitution (or a constitution of the Company in force from time to time before the Amending Date), By-Laws, Code of Professional Conduct or the Applicable Regulations” in failing to provide a satisfactory explanation in writing with respect to the matters referred to in the Complaint as required by By-Law 5.2(a)(iii) of the 1 October 2024 By-Laws.
- Article 36(a) in that he had “committed, participated in or been involved with an Adverse Event” as defined in Article 76(c) by having “breached this Constitution (or a constitution of the Company in force from time to time before the Amending Date), By-Laws, Code of Professional Conduct or the Applicable Regulations” in failing to provide further information in respect of the Complaint as required by By-Law 5.2(b)(ii) of the 1 October 2024 By-Laws.
Mr Donald Douglas attended the Disciplinary Tribunal Hearing and admitted all the complaints.
Penalty and Costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
Complaint 1:
- Forfeiture of membership, not eligible for readmission for a period of three years.
- Prior to any application for readmission, the member must complete 120 hours of CPD and provide evidence of same to the satisfaction of the GMPC.
Complaint 2:
- A severe reprimand.
- A Fine of $2000.
Complaint 3:
- A severe reprimand.
- A Fine of $2000.
The Member was ordered to pay CPA Australia’s costs of $9,327.25.
