On 9 May 2025 the Disciplinary Tribunal found Mr Donald Douglas breached CPA Australia’s 11 May 2022 Constitution:
- Article 36(a) in that he had “committed, participated in or been involved with an Adverse Event” as defined in Article 76(c) by having “breached this Constitution (or a constitution of the Company in force from time to time before the Amending Date), By-Laws, Code of Professional Conduct and the Applicable Regulations” in failing to hold a Public Practice Certificate in accordance with By-Law 9.1 when carrying out Public Accounting Services.
- Article 36(a) in that he had “committed, participated in or been involved with an Adverse Event” as defined in Article 76(e) for having “failed to observe a proper standard of professional care, skill or competence” by stating on letterhead that he was a part of the Professional Standards Scheme when he was not.
Mr Donald Douglas attended the Disciplinary Tribunal Hearing, admitted the complaints.
Penalty and Costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
Complaint 1:
- Forfeiture of membership.
- If Mr Douglas provides Professional Accounting Services, he will not be eligible for readmission until he successfully completes the Public Practice Program (online and workshop) and obtains a Public Practice Certificate with appropriate professional indemnity insurance.
- Within the first 12 months of holding his PPC, Mr Douglas must undertake a Program Review at his cost within the prescribed timeframes and should he fail to successfully complete the Program Review, his membership be immediately forfeited.
Complaint 2:
- An admonishment.
The Member was ordered to pay CPA Australia’s costs of $8,988.45.
