Two sample terms of engagement documents are now available in Word format to guide practitioners on preparing an engagement letter and on providing a brochure-type engagement document.
APES 305 Terms of engagement is effective from 1 July 2008 and replaces APS 2 Terms of engagement. From this date all members in public practice are required to document and communicate the terms of engagement in the engagement document.
The terms of engagement need not be in the form of a letter or agreement. A standard format handout, brochure, leaflet or electronic communication is also acceptable.
Matters that should be considered for inclusion in an engagement document include:
- purpose
- objectives
- scope
- output
- relative responsibilities
- involvement of other members in public practice
- fees and billing arrangements
- ownership of documents
- confirmation by the client
Engagement documents will vary according to the nature of the engagement and the terms of appointment of the member in public practice. The matters referred to above should be varied to meet the individual requirements and circumstances of each engagement.
